Terms of Service

Terms for using Our20 and its family coordination features.

These Terms of Service (“Terms”) govern your use of the Our20 mobile application, related services, and Our20 website (together, “Our20”). Our20 is operated by Brushy Fork Technologies LLC, based in West Virginia, United States (“we,” “us,” or “our”). Our20 is currently in beta testing for iPhone.

1. Acceptance of These Terms

By using Our20, you agree to these Terms. If you do not agree, do not use Our20. If you authorize use by a minor as their parent or legal guardian, you agree to these Terms for yourself and authorize the minor’s use only to the extent you have legal authority to do so. Nothing here creates authority over another person or replaces consent required by law.

2. Eligibility, Accounts, and Family Roles

You must be legally able to enter into these Terms, or use Our20 under the authorization and supervision of a parent or legal guardian as permitted by applicable law. Access during beta may be limited by invitations, supported devices, account eligibility, and available features. You may not use Our20 where doing so would violate applicable law.

Provide accurate account information, keep your credentials secure, and use only accounts and devices you are authorized to access. Promptly contact support@our20app.com if you suspect unauthorized access. You are responsible for your own use and for activity you authorize; you are not automatically responsible for another person’s conduct merely because they are in your family group.

Family roles, including owner, parent, adult, or child, affect supported features and permissions. A role or birthday field does not verify age, establish legal guardianship, or grant legal authority to monitor someone. Available controls depend on the account, role, feature, and application version.

3. Minors and Parent or Guardian Responsibility

Parents and legal guardians are responsible for deciding whether Our20 is appropriate for a minor, authorizing permitted use, reviewing applicable permissions and sharing choices, and providing appropriate supervision. Explain to the minor who may receive their information and how family features operate.

A family invitation, supervision, acceptance of these Terms, or an in-app role is not a substitute for any legally required notice or verified parental consent. Do not enroll a child or provide a child’s information unless applicable legal requirements are satisfied. For children under 13, or below another applicable age threshold, use is permitted only where legally required parental notice, consent, and other protections have been established. These Terms do not represent that Our20 has implemented a verified parental-consent mechanism.

Parents or guardians may contact privacy@our20app.com concerning a child’s information or to request access, correction, deletion, or limits on further collection or sharing. We may verify identity and authority, and requests are handled subject to applicable law and the limitations described in our Privacy Policy.

4. Family Membership and Authorization

Invite, join, and manage family groups only with appropriate authorization. Do not impersonate another person, misrepresent guardianship, misuse invitations, or add or retain someone for covert monitoring. Family membership does not give every member access to every category of information; access depends on membership, permissions, feature rules, and supported sharing choices.

Review who belongs to your family and who receives information through each feature. Use available controls or contact support if membership or access needs to change. Leaving a family, removing a member, or changing sharing does not necessarily delete historical records or recall information, screenshots, messages, or notifications already received.

5. Location Sharing and Its Limits

Depending on permissions and the features used, Our20 may process and share precise location, last-known location, timestamps, and supported device information. Background location may be processed when appropriate permissions are enabled. Sharing rules can differ across features; turning off one kind of sharing does not necessarily end another separately authorized feature.

Location may be inaccurate, delayed, stale, incomplete, or unavailable. Device permissions, battery state, iOS restrictions, background execution limits, network conditions, provider availability, and other factors affect updates. A location marker or status does not establish a person’s present location, condition, or safety. Our20 does not promise continuous tracking. Changing device permissions may limit new collection without deleting previously processed information.

Use location features only for lawful, authorized family coordination. Do not use Our20 to stalk, coerce, harass, or secretly track someone.

6. Safe Places

Safe Places can use configured places and location evidence to produce supported arrival, departure, visit, or related activity. A Safe Place name is a label and does not mean the location is safe or has been inspected. Place boundaries, addresses, geocoding, and event detection may be inaccurate. An event may be late, duplicated, missed, or unavailable; the absence of an alert does not prove someone stayed at or outside a place.

7. Family Check-In

Family Check-In supports requests, responses, schedules, and related activity or notifications where available. Parents and children may use Check-In with one another as supported by their accounts, roles, and the application version. These Terms do not promise identical controls for every role.

Review the intended recipient, schedule, time zone, grace period, and supported recipients or escalation settings. A missed or late Check-In does not establish an emergency, and a response does not verify a person’s safety. Requests, responses, reminders, and escalations may fail or arrive late. Supported contextual information may include authorized last-known location, battery, or connectivity information. Check-In does not dispatch emergency responders or guarantee that anyone will see or act on an alert.

8. Watch My Trip

Watch My Trip allows supported trip information to be shared with selected family members. Trip sharing is separate from ordinary family location sharing. Turning off ordinary location sharing does not necessarily end an active trip’s sharing, and arrival does not itself end that sharing; use End Trip.

Trip status, destination, route information, distance, and estimated arrival or travel times may be inaccurate, delayed, or unavailable. A watcher’s access does not mean they are actively watching or will intervene. Do not operate Our20 while driving or when doing so would distract you from a task requiring attention.

9. Messaging and User Content

You retain ownership of content you provide, such as messages, profile images, calendar entries, and place descriptions. You grant us a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, and display that content only as reasonably necessary to operate, secure, maintain, and support Our20, fulfill your authorized sharing, and comply with law. This license does not transfer ownership or authorize unrelated advertising use of your content. It lasts only as needed for those purposes, including applicable retention and backup periods described in the Privacy Policy.

You must have the rights and permissions needed to provide and share content. Do not upload unlawful, infringing, threatening, abusive, or exploitative content. We may restrict or remove content that violates these Terms or applicable law, but do not undertake to review every message or verify user content.

Messages and read or delivery indicators may be delayed, incorrect, or unavailable. Our20 family messaging does not provide end-to-end encryption. Recipients may retain or share content outside Our20, and notification previews may be visible on a device’s lock screen. Consider what you share and your device notification settings.

10. Family Calendar, Alerts, and Activity

Family Calendar supports shared events, assignments, recurrence, destinations, and reminders where available. Calendar events may be visible to current family members even when only particular members are assigned. Review event details and permissions; assignment does not guarantee attendance or delivery of a reminder. Supported Time-to-Leave processing involves separate per-event authorization and may rely on location or routing information.

Alerts and family activity summarize supported events. Dismissing or hiding an item does not necessarily erase underlying records or stop related processing. Notifications may be missed, late, duplicated, out of order, or displayed after information changes. Calendar, alert, and activity features are coordination aids and should not be your sole means of communicating an important obligation or checking on someone.

11. Route History and Future Paid Features

Where supported and enabled, Route History may include coordinates, timestamps, distance, duration, available speed, and route-quality information. Availability, retention, and sharing depend on eligibility, authorization, settings, and technical conditions. Route and speed records may contain gaps or errors and are not certified evidence of driving conduct or safety.

Paid subscriptions are not currently publicly available. We may offer paid or Premium features in the future. Applicable prices, billing periods, renewal rules, cancellation methods, and other purchase terms will be presented when offered, before purchase. These Terms alone do not enroll you in a subscription or authorize a charge. Feature descriptions do not promise a future launch, price, or continued availability.

12. Acceptable Use

You must not:

  • violate applicable law or another person’s rights;
  • stalk, harass, threaten, coerce, exploit, or covertly monitor another person;
  • access an account, device, family group, or information without authorization;
  • bypass permissions, security controls, or sharing restrictions;
  • interfere with Our20, introduce malicious code, scrape private information, or impose unreasonable demands on the service;
  • use Our20 to distribute spam, commit fraud, or impersonate another person; or
  • copy, resell, or misuse Our20 or its content in violation of applicable licenses or intellectual property rights.

Restrictions do not prohibit conduct that applicable law expressly protects, including lawful security research conducted without unauthorized access or harm. Report suspected abuse or security problems to support@our20app.com.

13. Privacy

Our Privacy Policy explains collection, use, sharing, security, and retention. Our Privacy Choices page describes permissions and requests. Read both when deciding how to use Our20. These Terms do not expand sharing permissions or override privacy rights under applicable law.

Account closure, family removal, or revocation of sharing does not necessarily erase all information. Access, copies, correction, and deletion may require identity or authority verification and are subject to applicable law, shared records, operational needs, and backups. We do not promise immediate universal deletion or comprehensive automated export.

14. Intellectual Property and Application License

Our20 software, branding, designs, and service materials are owned by Brushy Fork Technologies or its licensors, except for user content and material governed by separate licenses. Subject to these Terms and applicable distribution terms, you may use the service for your personal, authorized family purposes. No ownership rights are transferred.

The license for an app obtained through Apple is governed by the applicable Apple standard licensed-application end-user license agreement or a separate custom license presented through Apple, if one is provided. These service Terms do not purport to replace that license. Open-source components remain subject to their applicable licenses.

15. Apple, iOS, and Third-Party Services

Apple’s applicable App Store, TestFlight, Apple Media Services, and device terms also apply to distribution and use through Apple. Comply with applicable third-party terms, including your network provider’s terms. Beta access may expire or be withdrawn under applicable distribution rules. Our20 family groups and roles are separate from Apple Family Sharing.

These Terms are between you and Brushy Fork Technologies, not Apple. We are responsible for Our20 and its content, and for applicable maintenance, support, product claims, and warranties that have not been lawfully disclaimed. Apple has no obligation to provide Our20 maintenance or support. Any Apple license provisions concerning warranty refunds, intellectual property claims, legal compliance, and Apple’s third-party beneficiary rights remain governed by the applicable application license and law. Our20 depends on services such as authentication, storage, maps, routing, geocoding, and push delivery. Third-party outages, changes, estimates, and platform restrictions can affect features. Their applicable terms and privacy practices govern their services. Links to external services do not guarantee or endorse their content.

16. Beta Status and Service Availability

Our20 is currently in beta testing for iPhone. Features, controls, compatibility, and availability may change, contain errors, or be discontinued. We may update, maintain, limit, or interrupt the service and will provide notice of significant changes when reasonably practicable or required by law. We do not promise uninterrupted access, preservation of every beta record, or that every feature will remain available. Keep independent copies of information you need where lawful and practicable.

17. Not an Emergency Service; No Safety or Delivery Guarantee

Our20 is not an emergency service and does not dispatch emergency responders. If you believe there is an emergency, contact 911 in the United States or the appropriate local emergency number directly.

Our20 does not guarantee safety or the accuracy, completeness, timeliness, availability, or delivery of location, notifications, Check-In requests or responses, trips, Safe Place events, estimated arrival times, connectivity information, messages, or reminders. A status, response, or alert is not proof that someone is safe, and a missing update is not proof of danger. Use direct communication and appropriate independent judgment. Our20 does not replace adult supervision or an emergency plan.

18. Suspension, Termination, and Account Closure

You may stop using Our20 at any time. Contact support@our20app.com for account assistance or privacy@our20app.com for account or information deletion requests. Uninstalling the app alone does not necessarily close an account or end all processing of previously supplied information.

We may restrict, suspend, or terminate access where reasonably necessary because of a material breach of these Terms, unlawful conduct, security or abuse concerns, legal requirements, or discontinuation of the service. Where reasonably practicable, we will provide notice and an opportunity to resolve the issue; immediate action may be necessary to protect users or the service. You may contact support to ask us to review an account restriction.

Termination ends your right to use the affected service but does not automatically delete records. Privacy rights and retention remain governed by applicable law and our Privacy Policy. Provisions that by their nature must continue, including content rights needed for lawful retention, intellectual property, liability, and dispute provisions, survive termination only to the extent applicable.

19. Disclaimers

To the extent permitted by applicable law, Our20 is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not warrant that Our20 will be error-free, secure against every threat, continuously available, or suitable for emergency reliance. No informal statement creates a guarantee of safety or feature performance.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded or limits our responsibilities beyond what applicable law permits.

20. Limitation of Liability

To the extent permitted by applicable law, Brushy Fork Technologies and its service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data, arising from use of or inability to use Our20. To that same extent, our total liability arising from Our20 or these Terms will not exceed the greater of US $100 or the amount you paid us for Our20 in the 12 months before the event giving rise to the claim.

These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence where liability cannot be limited, or any other liability or remedy that applicable law does not allow us to exclude or limit. If your jurisdiction does not permit a particular exclusion or limit, it applies only to the extent permitted there. Nothing limits nonwaivable consumer or privacy rights.

21. Indemnification

To the extent permitted by applicable law, you agree to reimburse us for reasonable losses, liabilities, and costs, including reasonable legal fees, resulting from a third-party claim caused by your intentional unlawful use of Our20, your knowing infringement of another person’s rights, or your material breach of these Terms. This does not require you to indemnify us for our own negligence or misconduct, impose responsibility on a minor beyond what law permits, or impose liability merely for belonging to a family group.

We will provide reasonable notice of a claim and a reasonable opportunity for you to participate in its defense. We will not settle a claim in a way that admits fault for you or imposes a nonmonetary obligation on you without your consent, which must not be unreasonably withheld.

22. Changes to Our20 and These Terms

We may change Our20 as described above and update these Terms. We will post the revised Terms with an updated date and give reasonable additional notice of material changes through available channels, or obtain agreement where required by law. Changes apply prospectively from their stated effective date and do not retroactively remove accrued rights. Continued use after properly notified changes take effect signifies acceptance to the extent permitted by law. If you do not agree, stop using Our20 and contact us for account assistance.

23. Governing Law and Courts

These Terms are governed by West Virginia law, without applying conflict-of-law rules, except that mandatory protections under the laws applicable to you remain in effect. Subject to those protections and applicable jurisdiction rules, disputes may be brought in state or federal courts of competent jurisdiction in West Virginia. Nothing prevents you from using another court where applicable law gives you that right.

These Terms do not require mandatory arbitration or waive class-action rights. You may contact support@our20app.com to try to resolve a concern informally, but doing so is not a prerequisite to exercising your legal rights.

24. General Terms and Contact

If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. A failure to enforce a provision does not waive later enforcement. These Terms, together with applicable feature or purchase terms expressly presented to you, form the agreement concerning the service; applicable application licenses and mandatory legal rights remain in effect.
